Letter to Congressmen

Dear Senators and Congressmen:

Our Capital Markets are an essential element of America’s Free Enterprise system. Stock prices affect every U. S. person not just investors. An Efficient Capital Markets provide money to companies that create good jobs. Our Capital Market must be free from inefficient regulations or other costs that all of us most pay. These costs include investment misallocations that occur when less deserving companies get access to nation’s savings and make it harder for good, hard working people to create good jobs. I have found a plan to cut cost and an regulation while improving the efficiency of our nation’s capital markets. I strongly believe it deserves to be made into law. It’s called the Asensio Three Step Plan.

The Asensio plan is uncontroversial and fair. It does not require any new bureaucracy or regulation. It does not create any new cost to industry and reduces government expenses. It also reduces abusive and unproductive securities litigation that is rampant in our capital markets. And most importantly, it helps protect our nation’s savings and improves our free enterprise capitalist system.

The Asensio Three Step Plan is very simple:

1) decentralize the SEC's Enforcement authority away from its politically-appointed, Washington, D.C. based Commissioners to existing Enforcement Officer at each of its regional local branches;

2) eliminate the regulatory bias against one type of investor over another (these include the up-tick restrictions, the stock borrowing requirement and the exclusions from the protections granted to other investors under the anti-fraud provisions of securities laws); and

3) eliminate existing restraints on freedom of speech that allow public companies to use funds obtained from the public to file lawsuits against analysts, media or other public commentators who have opposing opinions concerning statements issued by public companies.

These are simple, no non-sense easy to implement ideas. They work to add freedom and reduce inefficiencies. They add to American’s free speech, make the playing field more level and increase government efficiency. I firmly believe that the Asensio Three Step Plan deserves your serious consideration.
